POLICIES AND ACCESSIBILITY

CLIENT RESPONSIBILITES

  • Providing all required content, feedback, and approvals in a timely manner.

  • Ensuring that all materials shared are accurate, complete, and legally owned or licensed.

  • Understanding that delays in feedback, content, or payment may affect project timelines.

  • Reviewing all proofs and deliverables carefully before final approval. Once approved, Modern Legacy Atelier is not liable for overlooked errors.

  • Adhering to payment schedules outlined in their project agreement.

REVISIONS

The client is entitled to 3 revisions. Additional revisions will be billed at an additional fee specified in the contract.

The client agrees to provide all necessary content  in a timely manner, respond to communications, and provide feedback within 3-4 business days of receiving communication and deliverables, and obtain rights and permissions for all content provided.

CONFIDENTIALITY

Both parties agree to keep confidential any proprietary or sensitive information obtained during this project.

TERMINATION

This Agreement may be terminated by either party with written notice. In the event of termination:

If the company client terminates the Agreement before project completion, the client will remain responsible for:

  1. Payment of all work completed up to the termination date, billed at the agreed project rate or hourly rate, specified in the contract.

  2. Forfeiture of any deposit or retainer fees, which are non-refundable.

If termination occurs after substantial work has been completed, the client may also be invoiced for % of the remaining project balance to compensate for time reserved for the project deemed by the designer, specified in the contract.

The designer reserves the right to terminate this Agreement if:

  1. The client repeatedly fails to provide necessary feedback, content, or approvals.

  2. The client fails to make payments within the agreed timeframe.

  3. The client engages in behavior that makes it impossible to complete the project.

In such cases, the client will be invoiced for all work completed up to the termination date.

Upon termination, all rights to design concepts, drafts, and incomplete work remain with the designer unless otherwise agreed in writing. If the client has paid in full for completed deliverables, ownership of those deliverables transfers to the client, unless otherwise specified in writing. Termination does not affect confidentiality obligations or limitations of liability outlined in this Agreement.

LIMITATION OF LIABILITY

The designer is not liable for:

Losses due to downtime, server issues, or third-party service providers nor any damages beyond the amount paid by the client under this agreement.
